Terms of Service

These Terms of Service ("Terms") govern your access to and use of Market Post Pro ("we", "us", or "our"), including the website at www.marketpostpro.com and the Market Post Pro Chrome Extension (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using the Service, you represent and warrant that you meet these requirements. Market Post Pro is intended for use by automotive dealerships, independent dealers, and their authorized staff.

2. Account Registration and Approval

Access to the Service requires account registration via Google Sign-In. New accounts are subject to approval by a designated store manager or platform administrator before access is granted. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account.

3. Acceptable Use

You agree to use the Service only for its intended purpose: assisting authorized dealership staff in preparing and posting vehicle listings to Facebook Marketplace. You agree that you will not:

• Post vehicles that you do not have the legal right to sell
• Use the Service to create fraudulent, misleading, or deceptive listings
• Use the Service to scrape competitor inventory for purposes other than your own legitimate listings
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service
• Use automated scripts or bots to interact with the Service beyond the features provided
• Share your account credentials with unauthorized individuals
• Use the Service in any manner that violates applicable local, state, national, or international law
• Use the Service in any way that violates Facebook's Terms of Service or Community Standards

We reserve the right to suspend or terminate accounts that violate these acceptable use standards, with or without prior notice.

4. Chrome Extension

The Market Post Pro Chrome Extension is a tool that assists in extracting vehicle data from dealer vehicle detail pages and auto-filling Facebook Marketplace listing forms. By installing and using the extension, you acknowledge that:

• The extension operates within your browser and interacts with third-party websites at your direction
• You are solely responsible for ensuring your use of the extension complies with the terms of any third-party websites you visit
• We are not responsible for changes to third-party websites (including Facebook Marketplace) that may affect the extension's functionality
• The extension may be updated periodically; continued use constitutes acceptance of updates

5. Team and Store Features

Market Post Pro includes team management features that allow a designated manager to oversee the listing activity of their store's representatives. By using the Service as part of a team:

• Representatives acknowledge that their listing activity is visible to their store manager
• Managers are responsible for the conduct of the representatives they approve and oversee
• Store managers agree to use team data only for legitimate business management purposes

6. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Market Post Pro and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of these Terms.

You retain ownership of the vehicle listing data you create and upload. By using the Service, you grant us a limited license to store, display, and process that data solely to provide the Service to you.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that vehicle data extracted by the Service will be accurate or complete, as it depends on the content of third-party websites outside our control.

We are not affiliated with, endorsed by, or in any way officially connected with Facebook, Meta Platforms, Inc., or any of their subsidiaries. The Facebook Marketplace auto-fill feature operates through browser automation and may be affected by changes to Facebook's platform at any time.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Market Post Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Market Post Pro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights, including Facebook's Terms of Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. You may terminate your account at any time by contacting us at the email address below and requesting account deletion.

Upon termination, your right to use the Service will immediately cease. Sections 6, 7, 8, 9, and 12 of these Terms will survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Manitoba, Canada.

If you are a Canadian consumer, you may also have rights under applicable provincial consumer protection legislation, including the Manitoba Consumer Protection Act. Nothing in these Terms limits any rights you may have under applicable Canadian law that cannot be waived by contract.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
